While every divorce involves a unique set of interpersonal family law issues, the legal questions that must be resolved are largely the same. With that in mind, our team can help you with any or all of the following:

  • Child Custody and Visitation: If you have young children, your first priority is obviously ensuring their future after your marriage ends. Washington family law does not actually use the term “custody” when resolving who a child will live with or the parents’ ongoing role in making decisions for them. Instead, a court will approve a “parenting plan” that sets “residential time” for each parent. Ideally, the parents can work together to propose a parenting plan to the court, although the judge’s final decision must be based on the best interests of the child.
  • Division of Assets and Liabilities: Washington is a community property state. This means that each spouse has a 50-percent interest in any marital property. This does not, however, mean a court will necessarily divide community property down the middle. If the parties do not reach a voluntary agreement on how to divide assets and liabilities, a judge must make a “fair and equitable” distribution.
  • Child and Spousal Support: Washington has a Child Support Schedule that determines each parent’s financial obligations toward their children. In some divorce cases, one spouse may also seek support or “maintenance” payments, which are based on a number of factors.
  • Contempt and Enforcement of Decrees: Even after a judge issues a final divorce order, it may be necessary for one or both parties to return to court to enforce the terms of the final decree. This may include filing a motion to hold one spouse in contempt of court.
